Terms of Service

Version 1.5, published 2026-07-20 (replaces v1.4 of 2026-07-19). These terms apply to LiveInterpret.AI and the live.openchurch.cz instance, a live-interpretation service operated by Ondřej Plevka, sole trader (OSVČ), IČO 88181782, registered seat Nad úžlabinou 445/20, 108 00 Praha 10 – Malešice, Czech Republic ("the Operator"). Full identification and contact are in the Legal Notice.

1. The service

The service provides real-time AI translation of live speech (audio and captions) delivered to listeners' web browsers. Translation quality is produced by third-party AI models and varies by language pair, audio quality, and speaking style; it is provided as is and is not a substitute for certified human interpretation where legal, medical, or safety accuracy is required. You are responsible for the content of the speech you transmit and for having the right to translate and (if enabled) archive it.

2. Accounts and access

The service is offered for professional and organizational use: it is purchased by adults acting on behalf of an organization — a church, a conference host, or a similar body — and is not offered as a consumer service for private individual use (see also §2a on age restrictions and operation). Where an individual purchaser nevertheless qualifies as a consumer under applicable law, the consumer-protection provisions of these terms — in particular the withdrawal rights in §8 and the Refunds & Credits policy — apply in full as a protective fallback.

Organizations are onboarded after verifying their e-mail address; the Operator may review, suspend, or remove organizations that violate these terms. You are responsible for your organization's operator accounts and linked sender devices, for keeping credentials secret, and for revoking access (dashboard → Senders, or by removing operator users) when people or devices leave your team.

2a. Age restrictions and organizational responsibility

In this section "the Customer" means you — the organization or person that holds the account under §2. As set out in §2, the service is purchased and operated exclusively by persons aged 18 or over acting on behalf of an organization. Audience members may passively receive audio or captions selected and transmitted by the Customer. They are not authorized to operate the service, submit prompts or instructions, control its AI functionality, or independently provide content for processing. The Customer must: (a) ensure that all account holders, operators and persons controlling an interpretation session are at least 18 years old; (b) not market, configure or use the service as an interactive AI service for children; (c) control the distribution of listener links and access credentials; (d) provide all notices and obtain all permissions or other lawful bases required for the source audio and its audience; and (e) ensure that its use complies with any age or audience restrictions communicated by the Operator. During the limited organizational launch, the Customer must not transmit speech by a person under 18 for AI processing, even with parental authorization, unless the Operator has first approved a separate workflow in writing after reviewing the applicable upstream-provider terms or an alternative processing path. The Customer is responsible for use of the service under its account, including access or interaction that it permits contrary to these terms. The Operator may restrict or suspend a session or account where reasonably necessary to comply with applicable law or the terms of an upstream service provider. Nothing in this section transfers to the Customer any responsibility that applicable law or an upstream contract requires the Operator to retain.

3. Credits and payment

Usage is metered in language-minutes: 1 minute of one translated language during a live event, per active language session. It is bought two ways: prepaid packs (a balance valid 12 months from purchase) or a subscription (Standard, Premium). The Operator is currently not registered for Czech VAT (neplátce DPH). No VAT is added or itemized unless applicable tax law requires otherwise; the total price payable is always shown before the order is placed. Payments are processed by Stripe. See the Refunds & Credits policy.

3a. Subscriptions

A subscription grants a fixed monthly language-minute allowance, billed either monthly or as a 12-month term paid yearly. The allowance is granted each month; unused minutes roll over for one month and then expire, so it is a recurring allowance, not a refundable stored balance. Usage draws on the monthly allowance first, then any prepaid packs. If you enable overage and set a spend cap, minutes beyond the allowance are charged at the plan's per-minute rate and invoiced monthly. You can cancel any time yourself: the dashboard's Billing section opens Stripe's secure billing portal, where you can cancel the plan, update your payment card, and download your invoices. Cancelling stops the next renewal and takes effect at the end of the period already paid for; access and monthly allowances continue to the end of that term, and a running event is never interrupted. Subscription prices are locked for the paid term; the overage rate may change only at renewal. Annual terms are paid upfront and, once begun, are not pro-rated on mid-term cancellation. Consumers additionally have the separate statutory 14-day right of withdrawal described in §8 and the Refunds policy.

3b. Price changes

The Operator may change prices — subscription fees, per-minute overage rates, and one-off pack prices — for future purchases and renewals. The core cost of the service is a third-party AI model (currently Google's Gemini live-translation model), which the Operator does not control; if that model's price rises materially, the Operator may increase subscription, overage, and pack prices reasonably and proportionately to keep the service sustainable. A price change never affects prepaid packs you have already bought (honoured at their purchased minute value for their 12-month validity) or the fee of a subscription term you have already paid for (locked until its renewal; the overage rate may change only at renewal). Changes that will affect an active subscriber's next renewal are announced to the contact e-mail on file at least 14 days beforehand, so you can cancel before they take effect.

4. Acceptable use

You may not use the service for unlawful content, to infringe others' rights, to transmit others' speech without a lawful basis, to attempt to disrupt the service or other organizations' instances, or to resell access without a separate agreement. Practice mode (synthetic translation) is free of charge and intended for rehearsal and training; the Operator may apply reasonable fair-use limits to practice mode to prevent abuse.

5. Support and availability

Support is provided asynchronously (typically within ~24 hours on weekdays); there is no live support during events and no formal SLA at these prices. The service is engineered to self-recover, targets ~99.5% availability of event hours, and maintenance is never scheduled on Sunday mornings (CET). Incidents are published on the status page when available.

The translation is produced by a third-party AI model (currently Google's Gemini live-translation model), which the Operator does not control. If its provider retires, removes, or materially degrades that model, the Operator will make reasonable efforts to migrate the service to a suitable replacement model of comparable capability. If no suitable replacement is available at that time, live translation may be placed into temporary maintenance (partial or full suspension) until a suitable model can be integrated. During such maintenance, active subscription time is extended by the affected period on request and unused prepaid packs remain valid and refundable per the Refunds policy. The Operator is not liable for a third party's discontinuation of its model, but will not charge for translation the service cannot deliver.

5a. Changes to the service

Beyond what is needed to keep the service in conformity, the Operator may modify the service's features only for a valid reason stated in these terms: adaptation to changes in the third-party AI models the service depends on, security or capacity needs, changes in law, or genuine technical and operational improvement (Directive (EU) 2019/770, Art. 19; §§ 2389a et seq. of the Czech Civil Code). Such a modification is made at no additional cost to you and announced to the contact e-mail on file. If a modification negatively affects your access to or use of the service more than insignificantly, you may terminate the contract free of charge within 30 days of the notice (or of the modification, if later) and receive a pro-rata refund of prepaid amounts: unused pack minutes and the unused remainder of a prepaid subscription term.

6. Liability

To the extent permitted by law, the Operator's aggregate liability is limited to the amount you paid for the service in the 12 months preceding the claim. The Operator is not liable for indirect damages, lost profits, or the content or accuracy of translated speech. Nothing in these terms limits liability that cannot be limited under Czech law.

7. Data protection

See the Privacy Policy and, for organizations, the Data Processing Addendum. The service itself writes no event audio to disk; the translation provider may retain session state briefly to support reconnection, as described in the Privacy Policy. Transcripts are stored only where archiving is enabled for your organization.

8. Consumers

Where you contract as a consumer (a natural person acting outside their trade or profession), you may withdraw from a distance contract within 14 days without giving a reason (§ 1829 of the Czech Civil Code; Directive 2011/83/EU). Because packs and subscriptions enable a digital service you can use immediately, at checkout you expressly request that the service be made available before the withdrawal period ends. The consequences differ by what you bought:

Prepaid packs. Each one-off pack purchase is a separate contract and carries its own 14-day withdrawal right — every pack you buy, not just the first. If you withdraw, you pay only for the part already provided (the value of language-minutes actually consumed, at that pack's equivalent per-minute rate) and the rest of the price is refunded (§ 1834 Civil Code; Art. 14(3) of the Directive). Once that pack has been fully performed — all of its minutes consumed — the right of withdrawal for that pack lapses, as you acknowledge at checkout (§ 1837(a) Civil Code; Art. 16(a) of the Directive).

Subscriptions. A subscription is a continuous service, so the right of withdrawal does not lapse merely because you consume the minutes currently available to you. You may withdraw within 14 days of concluding the subscription contract (your first purchase of a given plan); you then pay a proportionate amount for the service already provided up to withdrawal (the value of language-minutes consumed, at the plan's equivalent per-minute rate — Art. 14(3) of the Directive; § 1834 Civil Code), access ends, and the rest of the price is refunded. Because the subscription price and its automatic renewal are clearly disclosed to you at checkout, before the contract is concluded, a periodic renewal does not open a new withdrawal window (CJEU C-565/22 Sofatutor); you can instead cancel at any time as described in §3a. Consumers also keep their statutory rights regarding conformity of digital services (§§ 2389a et seq. of the Czech Civil Code, implementing Directive (EU) 2019/770). Nothing in these terms limits those rights; the "as is" wording in §1 describes the natural variability of AI translation quality and is not a waiver of them. Complaints (reklamace) are resolved within 30 days. Out-of-court dispute resolution is available through the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz, ADR portal adr.coi.cz); details are in the Legal Notice.

9. Termination

You may stop using the service at any time. The Operator may suspend or terminate access for a breach of these terms, with notice where practical. On termination, unused credits within their validity are refunded on request per the refund policy, and your organization's instance data is deleted per the DPA.

10. Changes and governing law

These terms may change; material changes are announced to the contact e-mail on file at least 14 days ahead. These terms are concluded in English and English is the contractual language for all markets. Czech law governs and the Czech courts have jurisdiction; for consumers this displaces neither the mandatory consumer-protection rules of the country where you live nor your right to bring or defend proceedings there (Regulation (EU) No 1215/2012; Rome I Regulation, Art. 6).

Internal compliance and legal review completed and updated through 2026-07-20. These terms are maintained by the Operator and reviewed against the live platform. Changelog: v1.5 (2026-07-20) adds the limited-launch prohibition on transmitting speech by under-18 speakers unless the Operator first approves a separate workflow in writing after reviewing upstream-provider terms or an alternative path. v1.4 (2026-07-19) implements the organizational launch position: §2 now states the professional/organizational offering — the service is purchased by adults acting on behalf of an organization and is not offered as a consumer service for private individual use — while keeping every consumer-protection provision (§8 withdrawal, Refunds policy) fully applicable as a protective fallback where an individual purchaser nevertheless qualifies as a consumer; §2a cross-references §2. v1.3 (2026-07-19) adds the age-restrictions and organizational-responsibility section (§2a) following the legal review of minors and AI-control risk allocation, and states English as the contractual language for all markets (§10). v1.2 (2026-07-19) incorporates the legal review — per-purchase pack withdrawal windows and the pack/subscription regime split with the renewal-disclosure condition (§8), the changes-to-the-service clause (§5a), the VAT wording, and the event-audio statement aligned with the Privacy Policy (§7). v1.1 (2026-07-18) states the consumer-withdrawal mechanics in full, adds self-serve cancellation via the billing portal, adds conformity-rights and dispute-resolution notes, and clarifies practice-mode fair use. v1.0 published 2026-07-12.
